Haptech Limited Product Warranty and Repair Policy
Haptech warrants to the original End User that Haptech Product(s) will perform substantially in accordance with the Documentation for a period of one year from the date of purchase (the “Limited Warranty Period”). During the Limited Warranty Period, Haptech will, as its sole obligation and the End User’s sole and exclusive remedy for any failure of the Haptech Product(s) to meet the Limited Warranty set forth herein, repair or replace (at Haptech’s sole option) the Haptech Product. Haptech’s repair or replacement of any Product that fails to meet the Limited Warranty set forth hereunder is conditioned upon End User’s provision of proof of purchase (in the form of product registration, packing slip, or invoice) within the Limited Warranty Period and use of the Product in accordance with the Haptech Product Documentation, including the End User License Agreement.
The Limited Warranty shall be voided if the Products are modified, tampered with, misused, or subjected to unusual or abnormal working conditions. The Limited Warranty excludes physical damage to the surface of the Product or normal wear and tear. The Limited Warranty does not apply to the extent that the Product defect or malfunction results from (i) the use of this Product in conjunction accessories, software, products, or peripheral equipment provided by any party other than Haptech; (ii) modification, tampering, reverse engineering, or repair of Products by any party other than Haptech; or (iii) use of the Product in any manner not expressly authorized under this Agreement.
Upon receipt of any Product returned in connection with a warranty claim, Haptech will attempt to recreate the error or malfunction. If Haptech, in its sole discretion, determines that the repair of the returned Product is not covered under the Limited Warranty set forth herein due to the End User’s misuse, combination with a product not provided by Haptech, or normal wear and tear, Haptech will notify the End User in writing that the repair or replacement is not covered by the Limited Warranty. If the End User chooses to proceed with repair of a Product that is not covered under the Limited Warranty, the End User shall be responsible for all costs associated with such repair or replacement, including without limitation the cost of parts, labor, and freight (shipping) associated with such repair.
TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW. HAPTECH EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF FITNESS OR SUITABILITY FOR A PARTICULAR USE OR PURPOSE, ACCURACY, TITLE, OR NON-INFRINGEMENT, AND HAPTECH SHALL IN NO EVENT BE LIABLE TO PURCHASER FOR INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND OR CHARACTER.
